www.xterrace.com is a site operated by X Terrace Fashion Ltd. (“we” or “us”). We are registered in England and Wales under company number 9324493 and have our registered office at 80 Knightsfield, Welwyn Garden City, AL8 7HB, UK.

X Terrace provides a website platform to facilitate communication between registered users (“users”), being fashion industry freelance professionals (“talents”) and fashion companies (“clients”), where talents may display their information in a publicly viewed profile, and clients may advertise short or long-term jobs for talents to apply for. We also display information for locations where fashion events may take place (“locations”).

Accessing our site
Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice. We will not be liable if for any reason our site is unavailable at any time or for any period.
From time to time, we may restrict access to some parts of our site, or our entire site, to users who have registered with us.
If you are under the age of 18, you may not use the services on our website. We reserve the right to refuse to offer the services to any person or entity and change eligibility criteria at any time. Where these terms or use of the services is prohibited or conflicts with any applicable law, rule or regulation, the right to access the services is revoked.
You are responsible for making all arrangements necessary for you to have access to our site. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms, and that they comply with them.

Jobs board conditions
Jobs that are somehow related to nudity or eroticism are not allowed.
Jobs are not allowed on sale of products, such as: beauty products, cosmetics, cosmetics, clothing, related accessories, and so on.

Conditions for Users
To read, understand and accept in full the present Terms of Use, accept and comply with them without exception for the entire period of their User status.
Act on xterrace.com in an appropriate manner according to the Law, and do so according to the common norms of good faith, civility and respect.
Have reached the age that corresponds to the country where the User is a citizen, provided that it is greater than or equal to that of 18 years. Otherwise, a parent or legal guardian must submit to X Terrace the documentation specified during the registration process, in order to acquire the responsibilities arising from these Terms of Use on behalf of the User.

Users must not be related in any way to any of the following activities:
Realization, promotion or collaboration in the making of photographs or recordings of images whose contents are related to a greater or lesser extent with eroticism, pornography, nakedness of the human body, activities that violate the Laws on the protection of minors, Privacy or Honor, or any related activities.
Distribution, sale or subscription services of material or services of scout, representation, intermediary or similar, related to eroticism, pornography, massage, relaxation, company, prostitution or Internet contacts services, Telephone, press or the like.

User profiles
Users must comply with the following Conditions of Use, in particular reference to those Contents published in their profile, in their messages and other means of introducing Content that xterrace.com has:
Provide in the User profile only detailed, up-to-date and accurate information. This information should be entered in the User profile, and not through links to external web pages.
Include in the User profile at least textual information and photographs sufficient to demonstrate their activity, experience and curriculum.
Offer only information in the User profile referring to the same User, and not to other persons or companies. It is prohibited, therefore, the inclusion of information regarding other people, or the sending of User Messages on behalf of other people.
Any communication or publication by means of the User’s File, the User’s Messages or the User profile in general, which for its textual or graphic content is threatening, obscene, defamatory, erotic, pornographic, xenophobic, is against the dignity of the The rights of the child, honor or privacy, the legality in force, or when it impairs, defames or disparages the reputation or credit of X Terrace or any other person or entity, or is considered as a case of illegal, misleading or Unfair, or any other conduct that incites or constitutes the carrying out of a criminal offense.
The inclusion of information through the User’s File, the User’s Messages or the User’s Content in general, which is false, inaccurate, that induces or is likely to mislead the other Users or the X Terrace Staff, or that offer insufficient or difficult to verify information.
It is forbidden to include any User profile that is protected by Intellectual or Industrial Property Right, Copyright or Image Right, when the User does not have the relevant authorization of the holder.
The user assumes all responsibility for its User profile and disclaims X Terrace and its owner from any responsibility for them, including responsibilities related to damages, litigation or complaints that these User profile may cause in other persons, and those responsibilities On the expenses that these actions could generate. The User assigns to X Terrace the necessary rights to the contents that he uploads to X Terrace for publication in xterrace.com, X Terrace’s Mobile Application and X Terrace’s social profiles on Facebook, Twitter, and Instagram. The user makes this assignment exclusively for these uses in all the countries of the world, and in no case X Terrace considers any other additional assignment, nor acquires any property on the contents of the User. X Terrace may not sell, assign, license, or otherwise assign any of its User profile not considered in the foregoing paragraph without the express consent of the User.
X Terrace regularly selects some of the User profile (usually photographs) to be promoted through its social profiles on Facebook, Twitter, and Instagram etc. In such cases, X Terrace will always clearly indicate the authorship of the selected Content and, when technically possible, will also include the links and other related information that the User has indicated.
The User may request the withdrawal of publication of any of its Contents, or deny its assignment of rights at any time by contacting X Terrace via email info@xterrace.com. In such cases, X Terrace will not acquire any right of compensation of any kind.

Conditions for User Messages
The following Conditions of Use apply to all Registered Users, in relation to User Messages and User Content in general:
It is a requirement to provide ample and sufficient information about the proposal, offer or communication that is made.
Users’ communications through User Messages whose purposes, by the nature of the communication, are different from those for which xterrace.com was designed, are prohibited.
Communications of proposals of work, collaboration or similar ones related to the photography of nude or eroticism in any of its disciplines are prohibited.
User Messages and, in general, the introduction of information in the User Content whose nature indirectly contravenes the present Conditions of Use, inciting the establishment of contact or subsequent information by other means for the development of activities with Contrary ends to which xterrace.com was designed, are prohibited.

Conditions for Photographs
The following Conditions of Use apply to all Users, in relation to the photographs included in the User profiles, and to the User Content in general:
Photos in the User’s Profile must have the minimum technical and artistic quality.
The inclusion of nude or erotic photographs that are considered inappropriate by the X Terrace Staff is not allowed, either by subjective evaluation of their technical and artistic quality or by not corresponding to the purposes for which X Terrace was designed.
It is forbidden to include photographs in which children of any sex appear with the torso uncovered. This condition is especially applicable to models of young age and babies.

Viruses, hacking and other offences
You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

Email marketing /physical mail / text messages & subscription
Under the GDPR we use the consent lawful basis for anyone subscribing to our newsletter or marketing mailing list. We only collect certain data about you, as detailed in the “Processing of your personal data” above. Any email marketing messages we send are done so through an EMS, email / text marketing service provider. An EMS is a third party service provider of software / applications that allows marketers to send out email marketing campaigns to a list of users.

Email marketing messages that we send may contain tracking beacons / tracked clickable links or similar server technologies in order to track subscriber activity within email marketing messages. Where used, such marketing messages may record a range of data such as; times, dates, I.P addresses, opens, clicks, forwards, geographic and demographic data. Such data, within its limitations will show the activity each subscriber made for that email campaign.

Any email marketing messages we send are in accordance with the GDPR and the PECR. We provide you with an easy method to withdraw your consent (unsubscribe) or manage your preferences / the information we hold about you at any time.
